Introduction

These Terms of Service constitute a binding and enforceable legal contract between Vingtun Ventures Limited and its affiliates. Vingtun Ventures Limited (“backtoschool.co.ke” , “Administrator”or “we”) operates an e-commerce website along with the related logistics and payment services for the purchase and delivery of schools’ back to school shopping through our platform.

Your access and use of our backtoschool.co.ke website as well as any related services and content will be governed by these Terms of Service and hence by accessing the website you confirm your understanding of these terms of service. We reserve the right to implement changes, modifications, additions as well as removal of aspects of these Terms of Service at any given time  as deemed fit for the best interest of all parties involved. All users also acknowledge that if they are unsure or have difficulty comprehending any aspect of these Terms and Service or have any questions regarding such they should reach out to us for clarification soonest possible.

Registration and use of the site

In order to access and use our platform you will be required to register an account by filling in and submitting some information including but not limited to providing details like user ID, password e.t.c.

Since our platform is designed to serve school students, their opening of accounts and accessing the site should be permitted and under direct supervision of their parents, legal guardians or authorized adults. These minors should have their parents or legal guardians read and agree to these Terms of Service prior to using the platform. By opting to use this platform, users will have to provide information that is true, accurate and complete and ensure to notify the Administrator of any unauthorized access to your account.

Pricing, Payment and Delivery

We seek to provide the most convenient and accurate prices for our users as we aim at evening out the prices from across all regions in a bid to address price discrimination on our users’ part. Payment of products and services should be completed at least twenty four hours before the expected delivery date to ensure the efficiency of preparation of products for shipment is smooth and effective. Delivery of products will be on the respective reporting days of the involved institutions and any exceptions should be communicated for us to put into consideration.

Returns and Refunds

Return of any unsatisfactory, damaged or wrongly placed product will be handled by us with utmost discretion. Refunds in relation to that will be by way of immediate product replacement that was as exactly ordered.

Intellectual Property Rights and Infringements

All parties involved, including but not limited to our affiliates and licensors, agree that we own and control the copyright and related intellectual property on our website. Our logos and other related trademarks belong exclusively to us, and as such we reserve all rights and give no external rights for the use of those. Consequently, any third party trademarks and services on our website, both registered and unregistered, remain the property of their respective owners and as such we can not grant permission for their use. Use of those will be granted as expressly authorized by our licensors.

In case you are an intellectual property rights holder and have reason to believe that we have breached your intellectual property rights, you should contact us with your basis of the same. You will be required to provide us with objects or aspects of the intellectual property rights you feel were infringed.

Data Protection and Privacy

All personal information gathered in the course of use of the website will be held and used in accordance with the terms of our Privacy Policy.

Indemnity

You agree to indemnify us together with our affiliates, directors, suppliers, licensors, representatives as well as our employees and hold us free from any claims and demands, including  legal fees brought about by your breach of these Terms of Service. Our indemnification extends to any tax obligations and liabilities that we may incur whatsoever due to your failure to pay, withhold or declare your due taxes and other legal obligations and requirements.

Arbitration

In case any differences, disputes or infringements whatsoever arise from the interpretation, implementation, adherence and enforcement of these Terms of Service, they will be handled by an arbitrator independent to all parties involved and appointed following the rules of the Chartered Institute of Arbitrators. The governing of these Terms of Service will be in accordance to the laws of Kenya and the official language of communication will be English.
